Abstract 

Intellectual property is no longer seen as a distinct or self-contained domain, but rather as an important and effective policy instrument that would be relevant to a wide range of socioeconomic, technological and political concerns.

The issues of intellectual property rights and their role in development, especially of the poorer nations, have engaged the attention of stakeholders across the world over the past few decades. Balancing the interests of the innovator and that of the society at large in an equitable and ethical way has been at the heart of the central debate.

The lecture will focus on the current `balancing position’ that has been reached in the area of health, agriculture and education vis-à-vis availability, affordability and accessibility of products and services for the poor. It will draw lessons from these for shaping the policies on information, knowledge and material about and from oceans. In particular, it will deal with the issues of intellectual property concerns on ocean data, oceanic bioactive material, etc.

The issues of ocean data are special, most importantly with respect to the importance of their accessibility to stakeholders such as the maritime community, research and academic institutions, environmental groups, etc. Further, a distinction needs to be made between on-line, recent past and historical data. The importance of sharing these globally from the perspective of creating global good (such as mitigation of global warming) needs also to be considered.

The rich biodiversity of the oceans connected with bioactive materials of consequence in the area of healthcare, and economics, also needs significant attention and action. The complex issues connected in generation, protection and valorization of such oceanic biomaterial and new knowledge will also be discussed.

Bio

Dr. Mashelkar, born in 1943, has a distinguished academic and science management career. His last appointment was Director General of CSIR starting in 1995 and continuing through to 2006. CSIR (India) is the largest science and industrial chain of laboratories, which organization he led with distinction - conceiving and successfully implementing the process of transformation of CSIR during his tenure.  He has been elected Fellow of several prestigious academies both in India and abroad – importantly the Fellow of Royal Society, London, and Foreign Fellow of US National Academy of Engineering both in 2003. He was elected President of the Indian National Science Academy in 2005. Dr Mashelkar has played an important role in raising awareness of Intellectual property in India and served as Chairman of the Standing Committee on Information Technology of World Intellectual Property Organisation (WIPO) and as a member of the UK Intellectual Property Rights Commission. The President of India honoured Dr. Mashelkar with civilian honors – the Padmashri and the the Padmabhushan in 1991 and 2000 respectively for his contribution to nation building. Dr Mashelkar is presently the CSIR Bhatnagar Fellow based at the National Chemical Laboratory, Pune, India.

This series of lectures is dedicated to the memory of the noted Indian marine zoologist and third chairman of the Commission, Dr Nedumangattu Kesava Panikkar (1913-1977). The "N.K. Panikkar Memorial Lectures” were established at the Eighteenth Session of the IOC Assembly (1995) “to address capacity building in marine science issues at regional and/or national levels”.
